第一章 入 境
Chapter I,Entry
? 第一条 外国人入境，应当向中国的外交代
表机关、领事机关或者外交部授权的其他
驻外机关申请办理签证。
Article l For entry to China,aliens shall
apply for visas to Chinese diplomatic
missions,consular posts or other foreign
－ based agencies authorized by the
Foreign Affairs of the People's Republic of
China,
? 第四条 签发普通签证时，根据外国人申请来中国的事由，
在签证上标明相应的汉语拼音字母：
Article 4 Ordinary visas shall be marked with different
Chinese
phonetic letters and issued to different aliens according
to their stated purposes of visit to China.
（一） D字签证发给来中国定居的人员；
l） Visa D to aliens who are to reside permanently in
China；
（二） Z字签证发给来中国任职或者就业的人员及其随行
家属；
2） Visa Z to aliens who come to China to take up posts
or employment and to their accompanying family
members；
? （三） X字签证发给来中国留学、进修、
实习 6个月以上的人员；
3） Visa X to aliens who come to
China for study,advanced studies or
Job— training for a period Of six
months or more；
? （四） F字签证发给应邀来中国访问、考察、讲
学。经商、进行科技文化交流及短期进修、实习
等活动不超过 6个月的人员；
4） Visa F to aliens who are invited to China on
a visit or on a study,lecture or business tour，
for scientific technological or cultural exchanges，
for short－ term refresher course or for Job－
training,for a period not more than six months；
? （五） L字签证 发给来中国旅游、探亲或者因其
他私人事务人境的人员，其中 9人以上组团来中
国旅游的，可以发给团体签证；
5） Visa L to aliens who come to China for
sightseeing,visiting relatives or other private
purposes（ A group visa may be issued to a
group of nine or more aliens on a sightseeing
trip to China）；
（六） G字签证发给经中国过境的人员；
6） Visa G to aliens passing through China；
? （七） C字签证发给执行乘务、航空、航运任务的国际列
车乘务员、国际航空器机组人员及国际航行船舶的海员及
其随行家属：
7） Visa C to train attendants,air crew members and
seamen operation.
（八） J－ l字签证发给来中国常驻的外国记者,J－ 2字签
证发给临时来中国采访的外国记者。
8） Visa J－ 1 to resident foreign correspondents in
China； visa J－ 2 to foreign correspondents who make
short trip to China on reporting
tasks．
? 第七条 下列外国人不准人境。
Article 7 Aliens coming under the following
categories shall not
be allowed to enter China．
（四）患有精神病和麻疯病、艾滋病、性
病、开放性肺结核病等传染病的；
An alien suffering from mental disorder，
leprosy,AIDS,venereal diseases，
contagious tuberculosis or other infectious
diseases；
第二章 入出境证件检查
Chapter II Inspection of
Entry and Exit Certificates
? 第十三条 外国人出境，须缴验有效护照或
者其他有效证件，以及准予在中国停留的
签证或者居留证件。
Article 13 For exit,aliens shall submit for
examination their valid passports or other
valid certificates as well as visas or
residence certificates permitting their stay
in China．
第三章 居 留
Chapter III
Residence
? 第十六条 持标有 D,Z,X,J－ l字签证的外国人，必须自
人境之日起 30日内到居住地市、县公安局办理外国人居
留证或者外国人临时居留证。上述居留证件的有效期即为
准许持证人在中国居留的期限。
Article 16 Aliens holding visas D,Z,X or J－ l shall，
with－ in 30 days of entry into China,obtain aliens
residence cards or aliens's temporary residence cards
from the city or county public security bureau the place
of their residence,The period validity Of the
aforementioned certificates is the duration of the holders
permitted stay in China．
? 外国人居留证，发给在中国居留 1年以上的人员。
Aliens’ residence is issued to those who stay in China
for one year or more.
外国人临时居留证，发给在中国居留不满 1年的人员。
Aliens' temporary residence cards are issued to those
who stay less than one year in China．
持标有 F,L,G,C,J— 2字签证的外国人，可以在签证
注明的期限内在中国停留，不需办理居留证件。
Aliens’ holding visas F,L,G,C or J－ 2 may stay in
China for the period prescribed in their visas without
obtaining residence certificates.
? 第十七条 外国人申请居留证件须回答被询问的有关情况并履行下列
手续：
Article 17 In applying for residence certificates,aliens shall
provide such information as requested and complete the following
procedures：
（一）交验护照、签证和与居留事由有关的证明；
l） Submit for examination their passports,visas and papers
supporting their purposes of residence
（二）填写居留申请表；
2） Fill in residence application forms；
（三）申请外国人居留证的，还要交验健康证明书，交近期 2寸半身
正面免冠照片。
3） In applying for aliens' residence cards,submit for examination
health certificates and recently－ taken two－ inch half— length，
bareheaded,full— face photos．
? 第十九条 根据中国政府同外国政府签订的协议免
办签证的外国人，需在中国停留 30日以上的，应
于人境后按本实施细则第十六、十七条申请居留
证
件。
Article 19 Aliens exempt from visas under
agreements signed between the Chinese and
foreign Governments shall,in case they wish to
stay in China for 30 days and upward,apply
upon entry into China for residence certificates
in accordance with Articles 16 and 17 of the
present Rules．
? 第二十条 外国人在签证或者居留证件有效期满后需继续在中国停留
或者居留，须于期满前申请延期。
Article III Aliens who need to prolong their stay or residence in
China beyond the expiration of their visas or residence certificates
should apply for an extension before the expiration of their visas or
certificates．
外国人在中国居留期间，如果发现患有本实施细则第七条第四项规定 的疾病，中国卫生主管机关可以提请公安机关令其提前出境。
Chinese authorities in charge of public health,when discovering
aliens,during their stay in China,to be afflicted with diseases
specified in sub-paragraph 4 of Article 7 of the present Rules may
request the public security organs concerned to order them to
advance their date of exit from China．
? 第二十一条 在外国人居留证上填写的项目内容（姓名、
国籍、职业或者身份、工作单位、住址、护照。号码、偕
行儿童等）如有变更，持证人须于 10日内到居住地公安
局办理变更登记。
Article 21 In case of any changes in the information
written in an alien's residence card（ such as name，
nationality,occupation,status,place Of work，
address,passport number and accompanying
children）,the holder of the card shall,within 10 days，
register such changes with the public security bureau at
the place of his／ her residence．
? 第二十二条 持外国人居留证的人迁出所在市。县，须于
迁移前向原居住地的公安局办理迁移登记，到达迁人地后，
须于 10日内向迁人地公安局办理迁
人登记。
Article 22 The holder of an alien's residence card who
wishes to move out of the city or county of residence
shall,before moving,register the move with the public
security bureau at the original place of residence and
shall,with in 10 days of arrival at the new place of
residence,register the move－ in with the public
security bureau at the new placed residence．
? 第二十三条 出于维护国家安全、社会秩序或者其他公共
利益的原因，市、县公安局可以限制外国人或者外国机构
在某些地区设立住所或者办公处所；已在上述限制地区设
立住所或者办公处所的，必须在市、县公安局迁移通知书
指定的期限内迁至许可的地区。
Article 23 For the sake of national security,public order
or other public interests,a city or county,pubic
security bureau may declare certain areas out of bounds
for the establishment of residences or offices by aliens
or foreign institutions,Residences and offices that have
already been established in these restricted areas shall
be moved to non－ restricted areas within the time limit
prescribed in the notice of moving issued by the city or
county public security bureau．
? 第二十四条 在中国定居的外国人必须每年一次在指定的
时间到居住地的公安局缴验外国人居留证。
Article 24 Aliens residing permanently in China shall，
once every year and at a prescribed time,submit their
residence cards for examination to the public security
bureau at their place of residence．
公安局认为必要时，可通知外国人到出入境管理部门缴验
外国人居留证，外国人应按通知指定的时间前往缴验。
The public security bureau may,when necessary ask an
alien to submit his/her residence card to the exit and
entry department for examination,and the alien shall
do so at the time prescribed in the notice．
? 第二十五条 在中国居留或者停留的年满 16
周岁以上的外国人必须随身携带居留证件
或者护照，以备外事民警查验。
Article 25 Aliens at the age of 16 and
upwards who reside or stay in China shall
carry with their residence certificates or
passports for possible examination by
police in charge of foreign affairs.
? 第二十六条 在中国出生的外国婴儿，须于
出生后 1个月内，由其父母或者代理人持出
生证明向当地公安局申报，办理登记手续。
Article 26 The parents of an alien infant
born in China or their agent shall,within
one month after his or her birth,report to
the local public security bureau with the
birth certificate and complete registration
procedures．
第四章 住宿登记
Chapter IV
Accommodation Registration?
第二十九条 外国人在宾馆、饭店、旅店、招待所、学校
等企业、事业单位或者机关、团体及其他中国机构内住宿，
应当出示有效护照或者居留证件，并填写临时住宿登记表。
在非开放地区住宿还要出示旅行证。
Article 29 For lodging at guesthouse,hostel,inn，
hotel,school or other enterprises and institutions or at
government organs or other Chinese organizations，
aliens shall present valid passports or residence
certificates and fill in registration form of temporary
accommodation,They shall present travel permits
when seeking accommodation in areas closed to
aliens．
? 第三十条 外国人在中国居民家中住宿，在城镇的，须于
抵达后 24小时内，由留宿人或者本人持住宿人的护照、
证件和留宿人的户口簿到当地公安机关申报，填写临时住
宿登记表；在农村的，须于 72小时内向当地派出所或者
户籍办公室申报。
Article 30 When an alien wishes to lodge at the home of
a Chinese resident in urban areas,the host or the
lodger shall,with in 24 hours of the lodger's arrival，
report to the local public security organ with the lodger's
passport and certificate as well as the host's residence
booklet and fill in registration forms of temporary
accommodation,In rural areas,the host or lodger
shall report to the local police station or residence
registration office within 72 hours of the lodger's
arrival．
? 第三十一条 外国人在中国的外国机构内或者在中国的外
国人家中住宿，须于住宿人抵达后 24 小时内，由留宿机
构、留宿人或者本人特住宿人的护照或者居留证件，向当
地公安机关申报，并填写临时住宿登记表。
Article 31 When an alien lodges at a foreign institution in
China or at the home Of an alien in China,the institution
in question or the host or the lodger shall,within 24
hours Of the lodger's arrival,report to the local public
security organ with the lodger s passport or residence
certificate and fill in registration forms of temporary
accommodation.
? 第三十二条 长期在中国居留的外国人离开自己的
住所临时在其他地方住宿，应当按本实施细则第
二十九、三十、三十一条规定申报住宿登记。
Article 32 Aliens having long— term residence in
China who wish to lodge temporarily elsewhere
than their own residence shall report and
register accommodation in accordance with the
provision of Article 29,30,and 31 of the
present Rules．
第五章 旅 行
Chapter V
Travel
? 第三十四条 外国人前往不对外国人开放的市。县旅行，须事行向所
在市、县公安局申请旅行证，获准后方可前往。申请旅行证须履行下 列手续：
Article 34 An alien wishing to travel to cities or counties closed to
aliens shall apply in advance for a travel permit to the public
security bureau of the city or county where he/she stays and may
proceed there only with permission,To apply for a travel permit,the
following procedures must be completed:
（一）交验护照或者居留证件；
1） Submit passport or residence certificate for examination；
（二）提供与旅行事由有关的证明；
2） Provide papers supporting the purposes of travel;
（三）填写旅行申请表。
3） Fill in a travel application form．
? 第三十七条 外国人未经允许，不得进人不
对外国人开放的场所。
Article 37 Aliens shall not enter places
closed to aliens without permission.
第六章 出 境
Chapter VI
Exit
? 第三十八条 外国人应当在签证准予停留的
期限内或者居留证件的有效期内出境。
Alticle38 Aliens shall leave China within
the time limit prescribed in the visas or
within the period validity of their residence
certificates．
? 第三十九条 持有外国人居留证件的人，在其居留证件有
效期内出境并需返回中国的，应当在出境前按本实施细则
第五、六条有关规定向当地公安机关申请办理返回中国的
签证。
Article 39 The holder of an alien's residence certificate
who wishes to leave and then re－ enter China within the
period of validity of the said certificate shall,before
leaving China,apply to the local public security organ
for a re－ entry visa in accordance with the relevant
provisions of Article 5 and 6 of the present Rules．
? 持有居留证件的外国人出境后不再返回中
国的，出境时应向过防检查站缴销居留证
件。
An alien holding a residence certificate
who does not wish to return to China after
exit shall hand in his／ her residence
certificate to the border check post upon
exit．
第七章 处 罚
Chapter VII
Penalties
? 第四十条 对非法人出中国国境的外国人，可以处 1000元
以上,10000元以下的罚款，或者处 3日以上,10日以下
的拘留，也可以并处限期出境或者驱逐出境；情节严重，
构成犯罪的，依法追究刑事责任。
Article 40 Aliens who illegally enter or exit China may be
fined from 1000 to 10000 Yuan（ RMB） or detained
from 3 to 10 days and may simultaneously be ordered to
leave the country within a specified time or expelled
from the country,Those whose offences are serious
enough to constitute a crime shall be prosecuted for
criminal responsibility according to law．
? 第四十二条 对违反本实施细则第十六、十九。二十条规
定，非法居留的外国人，可以处警告或者每非法居留一日，
处 500元罚款，总额不超过 5000元，或者处 3日以上,10
日以下的拘留；情节严重的，并处限期出境。
Article 42 Aliens who illegally stay in China in
contravention of the provisions of Articles 16,19 and
20 of the present Rules may be served a warning,fined
500 Yuan per day for the period of his／ her illegal stay
in China with the total sum of fine not exceeding 5000
Yuan,or detained from 3 to 10 days,Those whose
offences are serious may at the same time be ordered
to leave the country within a specified time．
? 对违反本实施细则第二十一、二十二条规定的外
国人，可以处警告或者 500元以下的罚款；情节
严重的，并处限期出境。
Aliens who violate Article 21 and 22 of the
present Rules may be served a warning,or
fined up to 500 Yuan,and those whose of
fences are serious may at the same time be
ordered to leave the country within a specified
time．
? 对违反本实施细则第二十三条规定，不执行公安机关决定
的外国人，在强制其执行决定的同时，可以处警告或者
1000元以上,10000 元以下的罚款；情节严重的，并处
限期出境。
Aliens who violate Article 23 Of the present Rules and
fail to carry out the decision of the public security organs
may,while being compelled to carry out the decision，
be served a warning or fined from 1000 to 10000
Yuan,Those whose offences are serious shall be
ordered to leave the country within a specified time.
? 第四十三条 对违反本实施细则第二十四、二十五条规定，
不按要求缴验居留证，不随身携带护照或者居留证件，或
者拒绝民警查验证件的外国人，可以 处警告或者 500元以
下的罚款；情节严重的，并处限期出境。
Article 43 Aliens who,in contravention of the provisions
of Articles 24 and 25 of the present Rules,fail to submit
their residence certificates for examination as required
or to carry their passports or residence certificates with
them or refuse to produce their certificates to police for
examination may be served a warning or fined up to 500
Yuan,and those whose offences are serious may at
the same time be ordered to leave the country within a
specified time．
? 第四十四条 对未经中华人民共和国劳动部或者其授权的
部门批准私自谋职的外国人，在终止其任职或者就业的同
时，可以处 1000元以下的罚款；情节严重的，并处限期
出境。
Article 44 Aliens who found employment without
permission from the Ministry Labor of the People’s
Republic of China or its authorized departments shall
have their posts or employment terminated and may at
the same time be fined up to 1000 Yuan,and those
whose offences are serious may at the same time be
ordered to leave the country within a specified time．
? 第四十五条 对违反本实施细则第四章规定，不办
理住宿登记或者不向公安机关申报住宿登记或者
留宿未持有效证件外国人的责任者，可以处警告
或者 50元以上,500元以下的罚款。
Article 45 Whoever is held responsible for failing
to register accommodation or report such
registration to the public security organ,or for
accommodating aliens without valid certificates
in contravention Of the provisions Of Chapter IV
of the present Rules may be served a warning
or fined from 50 to 500 Yuan．
? 第四十六条 对违反本实施细则第三十四、三十七
条规定，未经批准前往不对外国人开放地区旅行
的外国人，可以处警告或者 500元以下的罚款；
情节严重的，并处限期出境。
Afticle46 Aliens who travel to areas closed to
aliens without prior permission in contravention
of the provisions of Articles 34,and 37 of the
present Rules may be served a warning or fined
up to 500 Yuan,and those whose offences are
serious may at the same time be ordered to
leave the country within a specified time．
第八章 其他规定
Chapter VIII
Other Provisions
? 第五十二条 外国人申请各项签证、证件的延期或者变更，
须履行下列手续：
Article52 Aliens who wish to apply for extension or
alteration of visas or certificates shall complete the
following procedures;
（一）交验护照和签证、证件；
l） Submit their passports,visas and certificates
for examination；
（二）填写延期申请表或者变更申请表；
2） Fill in application forms for extension or
alteration;
（三）提供与延期或者变更事由有关的证明。
3） Provide papers supporting reasons for extension
or alteration.
? 第五十三条 外国人申请各项签证、证件或
者申请签证、证件延阻变更，必须按规定
缴纳签证、证件费。
Article 53 Aliens applying for visas and
certificates or for their extension or
alteration shall pay visa and certification
fees according to the prescribed rates.
? 第五十四条 不满 16周岁的外国少年儿童，与其父
母或者监护人使用同一护照的，随其父母或者监
护人来中国时，可以不单独办理人境、过境、居
留、旅行手续。
Alticle54 An alien child under the aged 16 who
uses the same passport with his/her parent or
guardian,need not,while visiting China with
his/her parent or guardian,go through the entry,
transit,residence or travel procedures
separately.
? 第五十五条 外国人所持中国的签证、证件如有遗
失或者损坏，应当立即向当地公安局出人境管理
部门报告，申请补领或者换发。遗失外国人居留
证的，须在当地政府报纸上声明作废。
Article 55 An alien whose Chinese visa or
certificate is lost or damaged shall promptly
report to the exit and entry department under
the local public security bureau and apply for a
new one or a replacement,An alien who has
lost his/her residence card shall declare the lost
card invalid in an official local newspaper.

Chinese authorities in charge of public health,when discovering
aliens,during their stay in China,to be afflicted with diseases
specified in sub-paragraph 4 of Article 7 of the present Rules may
request the public security organs concerned to order them to
advance their date of exit from China．
? 第二十一条 在外国人居留证上填写的项目内容（姓名、
国籍、职业或者身份、工作单位、住址、护照。号码、偕
行儿童等）如有变更，持证人须于 10日内到居住地公安
局办理变更登记。
Article 21 In case of any changes in the information
written in an alien's residence card（ such as name，
nationality,occupation,status,place Of work，
address,passport number and accompanying
children）,the holder of the card shall,within 10 days，
register such changes with the public security bureau at
the place of his／ her residence．
? 第二十二条 持外国人居留证的人迁出所在市。县，须于
迁移前向原居住地的公安局办理迁移登记，到达迁人地后，
须于 10日内向迁人地公安局办理迁
人登记。
Article 22 The holder of an alien's residence card who
wishes to move out of the city or county of residence
shall,before moving,register the move with the public
security bureau at the original place of residence and
shall,with in 10 days of arrival at the new place of
residence,register the move－ in with the public
security bureau at the new placed residence．
? 第二十三条 出于维护国家安全、社会秩序或者其他公共
利益的原因，市、县公安局可以限制外国人或者外国机构
在某些地区设立住所或者办公处所；已在上述限制地区设
立住所或者办公处所的，必须在市、县公安局迁移通知书
指定的期限内迁至许可的地区。
Article 23 For the sake of national security,public order
or other public interests,a city or county,pubic
security bureau may declare certain areas out of bounds
for the establishment of residences or offices by aliens
or foreign institutions,Residences and offices that have
already been established in these restricted areas shall
be moved to non－ restricted areas within the time limit
prescribed in the notice of moving issued by the city or
county public security bureau．
? 第二十四条 在中国定居的外国人必须每年一次在指定的
时间到居住地的公安局缴验外国人居留证。
Article 24 Aliens residing permanently in China shall，
once every year and at a prescribed time,submit their
residence cards for examination to the public security
bureau at their place of residence．
公安局认为必要时，可通知外国人到出入境管理部门缴验
外国人居留证，外国人应按通知指定的时间前往缴验。
The public security bureau may,when necessary ask an
alien to submit his/her residence card to the exit and
entry department for examination,and the alien shall
do so at the time prescribed in the notice．
? 第二十五条 在中国居留或者停留的年满 16
周岁以上的外国人必须随身携带居留证件
或者护照，以备外事民警查验。
Article 25 Aliens at the age of 16 and
upwards who reside or stay in China shall
carry with their residence certificates or
passports for possible examination by
police in charge of foreign affairs.
? 第二十六条 在中国出生的外国婴儿，须于
出生后 1个月内，由其父母或者代理人持出
生证明向当地公安局申报，办理登记手续。
Article 26 The parents of an alien infant
born in China or their agent shall,within
one month after his or her birth,report to
the local public security bureau with the
birth certificate and complete registration
procedures．
第四章 住宿登记
Chapter IV
Accommodation Registration?
第二十九条 外国人在宾馆、饭店、旅店、招待所、学校
等企业、事业单位或者机关、团体及其他中国机构内住宿，
应当出示有效护照或者居留证件，并填写临时住宿登记表。
在非开放地区住宿还要出示旅行证。
Article 29 For lodging at guesthouse,hostel,inn，
hotel,school or other enterprises and institutions or at
government organs or other Chinese organizations，
aliens shall present valid passports or residence
certificates and fill in registration form of temporary
accommodation,They shall present travel permits
when seeking accommodation in areas closed to
aliens．
? 第三十条 外国人在中国居民家中住宿，在城镇的，须于
抵达后 24小时内，由留宿人或者本人持住宿人的护照、
证件和留宿人的户口簿到当地公安机关申报，填写临时住
宿登记表；在农村的，须于 72小时内向当地派出所或者
户籍办公室申报。
Article 30 When an alien wishes to lodge at the home of
a Chinese resident in urban areas,the host or the
lodger shall,with in 24 hours of the lodger's arrival，
report to the local public security organ with the lodger's
passport and certificate as well as the host's residence
booklet and fill in registration forms of temporary
accommodation,In rural areas,the host or lodger
shall report to the local police station or residence
registration office within 72 hours of the lodger's
arrival．
? 第三十一条 外国人在中国的外国机构内或者在中国的外
国人家中住宿，须于住宿人抵达后 24 小时内，由留宿机
构、留宿人或者本人特住宿人的护照或者居留证件，向当
地公安机关申报，并填写临时住宿登记表。
Article 31 When an alien lodges at a foreign institution in
China or at the home Of an alien in China,the institution
in question or the host or the lodger shall,within 24
hours Of the lodger's arrival,report to the local public
security organ with the lodger s passport or residence
certificate and fill in registration forms of temporary
accommodation.
? 第三十二条 长期在中国居留的外国人离开自己的
住所临时在其他地方住宿，应当按本实施细则第
二十九、三十、三十一条规定申报住宿登记。
Article 32 Aliens having long— term residence in
China who wish to lodge temporarily elsewhere
than their own residence shall report and
register accommodation in accordance with the
provision of Article 29,30,and 31 of the
present Rules．
第五章 旅 行
Chapter V
Travel
? 第三十四条 外国人前往不对外国人开放的市。县旅行，须事行向所
在市、县公安局申请旅行证，获准后方可前往。申请旅行证须履行下 列手续：
Article 34 An alien wishing to travel to cities or counties closed to
aliens shall apply in advance for a travel permit to the public
security bureau of the city or county where he/she stays and may
proceed there only with permission,To apply for a travel permit,the
following procedures must be completed:
（一）交验护照或者居留证件；
1） Submit passport or residence certificate for examination；
（二）提供与旅行事由有关的证明；
2） Provide papers supporting the purposes of travel;
（三）填写旅行申请表。
3） Fill in a travel application form．
? 第三十七条 外国人未经允许，不得进人不
对外国人开放的场所。
Article 37 Aliens shall not enter places
closed to aliens without permission.
第六章 出 境
Chapter VI
Exit
? 第三十八条 外国人应当在签证准予停留的
期限内或者居留证件的有效期内出境。
Alticle38 Aliens shall leave China within
the time limit prescribed in the visas or
within the period validity of their residence
certificates．
? 第三十九条 持有外国人居留证件的人，在其居留证件有
效期内出境并需返回中国的，应当在出境前按本实施细则
第五、六条有关规定向当地公安机关申请办理返回中国的
签证。
Article 39 The holder of an alien's residence certificate
who wishes to leave and then re－ enter China within the
period of validity of the said certificate shall,before
leaving China,apply to the local public security organ
for a re－ entry visa in accordance with the relevant
provisions of Article 5 and 6 of the present Rules．
? 持有居留证件的外国人出境后不再返回中
国的，出境时应向过防检查站缴销居留证
件。
An alien holding a residence certificate
who does not wish to return to China after
exit shall hand in his／ her residence
certificate to the border check post upon
exit．
第七章 处 罚
Chapter VII
Penalties
? 第四十条 对非法人出中国国境的外国人，可以处 1000元
以上,10000元以下的罚款，或者处 3日以上,10日以下
的拘留，也可以并处限期出境或者驱逐出境；情节严重，
构成犯罪的，依法追究刑事责任。
Article 40 Aliens who illegally enter or exit China may be
fined from 1000 to 10000 Yuan（ RMB） or detained
from 3 to 10 days and may simultaneously be ordered to
leave the country within a specified time or expelled
from the country,Those whose offences are serious
enough to constitute a crime shall be prosecuted for
criminal responsibility according to law．
? 第四十二条 对违反本实施细则第十六、十九。二十条规
定，非法居留的外国人，可以处警告或者每非法居留一日，
处 500元罚款，总额不超过 5000元，或者处 3日以上,10
日以下的拘留；情节严重的，并处限期出境。
Article 42 Aliens who illegally stay in China in
contravention of the provisions of Articles 16,19 and
20 of the present Rules may be served a warning,fined
500 Yuan per day for the period of his／ her illegal stay
in China with the total sum of fine not exceeding 5000
Yuan,or detained from 3 to 10 days,Those whose
offences are serious may at the same time be ordered
to leave the country within a specified time．
? 对违反本实施细则第二十一、二十二条规定的外
国人，可以处警告或者 500元以下的罚款；情节
严重的，并处限期出境。
Aliens who violate Article 21 and 22 of the
present Rules may be served a warning,or
fined up to 500 Yuan,and those whose of
fences are serious may at the same time be
ordered to leave the country within a specified
time．
? 对违反本实施细则第二十三条规定，不执行公安机关决定
的外国人，在强制其执行决定的同时，可以处警告或者
1000元以上,10000 元以下的罚款；情节严重的，并处
限期出境。
Aliens who violate Article 23 Of the present Rules and
fail to carry out the decision of the public security organs
may,while being compelled to carry out the decision，
be served a warning or fined from 1000 to 10000
Yuan,Those whose offences are serious shall be
ordered to leave the country within a specified time.
? 第四十三条 对违反本实施细则第二十四、二十五条规定，
不按要求缴验居留证，不随身携带护照或者居留证件，或
者拒绝民警查验证件的外国人，可以 处警告或者 500元以
下的罚款；情节严重的，并处限期出境。
Article 43 Aliens who,in contravention of the provisions
of Articles 24 and 25 of the present Rules,fail to submit
their residence certificates for examination as required
or to carry their passports or residence certificates with
them or refuse to produce their certificates to police for
examination may be served a warning or fined up to 500
Yuan,and those whose offences are serious may at
the same time be ordered to leave the country within a
specified time．
? 第四十四条 对未经中华人民共和国劳动部或者其授权的
部门批准私自谋职的外国人，在终止其任职或者就业的同
时，可以处 1000元以下的罚款；情节严重的，并处限期
出境。
Article 44 Aliens who found employment without
permission from the Ministry Labor of the People’s
Republic of China or its authorized departments shall
have their posts or employment terminated and may at
the same time be fined up to 1000 Yuan,and those
whose offences are serious may at the same time be
ordered to leave the country within a specified time．
? 第四十五条 对违反本实施细则第四章规定，不办
理住宿登记或者不向公安机关申报住宿登记或者
留宿未持有效证件外国人的责任者，可以处警告
或者 50元以上,500元以下的罚款。
Article 45 Whoever is held responsible for failing
to register accommodation or report such
registration to the public security organ,or for
accommodating aliens without valid certificates
in contravention Of the provisions Of Chapter IV
of the present Rules may be served a warning
or fined from 50 to 500 Yuan．
? 第四十六条 对违反本实施细则第三十四、三十七
条规定，未经批准前往不对外国人开放地区旅行
的外国人，可以处警告或者 500元以下的罚款；
情节严重的，并处限期出境。
Afticle46 Aliens who travel to areas closed to
aliens without prior permission in contravention
of the provisions of Articles 34,and 37 of the
present Rules may be served a warning or fined
up to 500 Yuan,and those whose offences are
serious may at the same time be ordered to
leave the country within a specified time．
第八章 其他规定
Chapter VIII
Other Provisions
? 第五十二条 外国人申请各项签证、证件的延期或者变更，
须履行下列手续：
Article52 Aliens who wish to apply for extension or
alteration of visas or certificates shall complete the
following procedures;
（一）交验护照和签证、证件；
l） Submit their passports,visas and certificates
for examination；
（二）填写延期申请表或者变更申请表；
2） Fill in application forms for extension or
alteration;
（三）提供与延期或者变更事由有关的证明。
3） Provide papers supporting reasons for extension
or alteration.
? 第五十三条 外国人申请各项签证、证件或
者申请签证、证件延阻变更，必须按规定
缴纳签证、证件费。
Article 53 Aliens applying for visas and
certificates or for their extension or
alteration shall pay visa and certification
fees according to the prescribed rates.
? 第五十四条 不满 16周岁的外国少年儿童，与其父
母或者监护人使用同一护照的，随其父母或者监
护人来中国时，可以不单独办理人境、过境、居
留、旅行手续。
Alticle54 An alien child under the aged 16 who
uses the same passport with his/her parent or
guardian,need not,while visiting China with
his/her parent or guardian,go through the entry,
transit,residence or travel procedures
separately.
? 第五十五条 外国人所持中国的签证、证件如有遗
失或者损坏，应当立即向当地公安局出人境管理
部门报告，申请补领或者换发。遗失外国人居留
证的，须在当地政府报纸上声明作废。
Article 55 An alien whose Chinese visa or
certificate is lost or damaged shall promptly
report to the exit and entry department under
the local public security bureau and apply for a
new one or a replacement,An alien who has
lost his/her residence card shall declare the lost
card invalid in an official local newspaper.
